Welcome to FamilyTreeTime. These Terms of Service ("Terms") are an agreement between you and Braemar Media Corporation ("BMC"), a California corporation ("FamilyTreeTime," "we," "us," or "our"), and they govern your use of the FamilyTreeTime website and app at familytreetime.com (the "Service").
By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
Questions? Email support@familytreetime.com.
FamilyTreeTime turns your family's key dates, births, weddings, and milestones, into a single grid that shows how old everyone was at every moment. You add people and events; we do the arithmetic. It's a keepsake tool, not a system of record. Ages and dates are calculated from what you enter and are provided for your enjoyment, not for legal, medical, financial, or genealogical certainty. Please don't rely on FamilyTreeTime's ages or dates for any official purpose.
You must be at least 13 years old to use the Service, and old enough to form a binding contract in your jurisdiction (or have a parent or guardian agree on your behalf). The Service is intended for adults building a personal record. Don't use the Service if we've previously banned you or if the law prohibits it.
Please don't:
We may suspend or remove content or accounts that break these rules.
All purchases are one‑time and final. Except where a refund is required by the law that applies to you, we do not offer refunds, credits, trial periods, or grace periods. This includes the $5 unlock and gifts, whether or not a gift has been redeemed. Because there is no subscription, there is nothing to renew or cancel; you keep what you bought. If you believe the law entitles you to a refund, email support@familytreetime.com and we will honor what the law requires. At checkout, we also ask you to confirm that you want immediate access to your purchase and that, where a cancellation or withdrawal right would otherwise apply to you (for example for consumers in the EU or the UK), you agree to waive it once access begins. For a gift, access begins when we send it to the person you chose.
The Service includes an "Ask" feature that answers simple questions, such as "How old was Uncle John when I was born?", by calculating from the people and events you've entered. It works on your device, without artificial intelligence, and nothing is sent to any outside service to answer. As always, the result is only as accurate as the dates you enter, so don't rely on it for legal, medical, financial, or official purposes.
The Service itself, the software, design, brand, and content we provide, belongs to BMC and is protected by intellectual‑property laws. We grant you a personal, non‑exclusive, non‑transferable, revocable license to use the Service for your own personal use, subject to these Terms. You don't get any rights to our software or brand beyond that.
If you send us ideas or suggestions, thank you. We may use them freely to improve FamilyTreeTime, without any obligation or payment to you.
We work hard to make FamilyTreeTime reliable, but we provide it "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non‑infringement. We don't warrant that the Service will be uninterrupted, error‑free, or that ages, dates, or calculations will be accurate. You're responsible for keeping your own backups of anything important (the app includes an export feature).
Some jurisdictions don't allow certain warranty disclaimers, so parts of this section may not apply to you.
To the fullest extent permitted by law, BMC and its owners, officers, and employees won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) US $20.
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
You agree to defend and indemnify BMC from third‑party claims and costs (including reasonable legal fees) that arise from your misuse of the Service, your content, or your violation of these Terms or of someone else's rights, for example a claim that you added someone's personal information without the right to do so.
These Terms are governed by the laws of the State of California, without regard to its conflict‑of‑laws rules.
Please talk to us first. Most concerns can be resolved quickly. Before starting an arbitration or a lawsuit, please email support@familytreetime.com with a short description of the dispute and what you'd like. We'll try in good faith to resolve it within 30 days.
Binding individual arbitration. If we can't resolve a dispute informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, rather than in court, except as stated below. The arbitration will be administered by JAMS under its applicable consumer arbitration rules, and may be conducted by video, by phone, or in Los Angeles County, California. The arbitrator will decide all issues, except that a court (not an arbitrator) will decide any question about the scope or enforceability of this arbitration agreement. Judgment on the award may be entered in any court with jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act.
Class‑action waiver. You and we agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not combine more than one person's claims or preside over any class or representative proceeding.
Exceptions. Either of us may still (a) bring an individual claim in small‑claims court if it qualifies, and (b) ask a court for an injunction or other equitable relief to stop infringement or unauthorized use of intellectual property or the Service.
Your right to opt out of arbitration. You may opt out of this arbitration agreement and class‑action waiver within 30 days of first accepting these Terms by emailing support@familytreetime.com with your name and a clear statement that you opt out of arbitration. Opting out won't affect any other part of these Terms.
If arbitration doesn't apply. For any dispute not subject to arbitration (including if you opt out), you and we agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and consent to venue there.
We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after a change means you accept the updated Terms.
We want FamilyTreeTime to work for everyone. If you run into an accessibility barrier, email support@familytreetime.com and tell us. We'll do our best to help and to fix it.
